Please read these Terms and Conditions (“Terms”, “T&Cs”) carefully before using the www.beverlycakes.com website (the “Service”) operated by Beverly Cakes (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Ordering and Custom Cakes

A. Acceptance of Orders

All orders placed through the Service are subject to acceptance by us. We reserve the right to refuse or cancel an order for any reason, including limitations on quantities available, errors in product or pricing information, or problems identified by our credit and fraud avoidance service.

B. Customization and Design

For customized cakes, we will make every effort to match requested designs and colors. However, due to the artistic and hand-crafted nature of our products, minor variations in color, texture, and design may occur. Photographs provided are illustrative.

C. Order Changes and Cancellations

  • Changes to custom orders (including flavor, size, or design) must be requested a minimum of 7 days before the scheduled pickup/delivery date.
  • Cancellations made 7 days or more before the date may be eligible for as required refund, minus any costs incurred (e.g., initial design fees or materials purchased).
  • Cancellations made less than 7 days before the date may result in the forfeiture of the entire amount paid.

2. Pricing and Payment

A. Pricing

All prices listed on the Site are in AED and are subject to change without notice. The price charged to you will be the price listed at the time you place your order, confirmed by us.

B. Payment

Payment for all orders must be made at the time of placing the order, unless otherwise agreed upon in writing (e.g., a deposit for large custom orders). We accept payment via Visa, MasterCard, PayPal, etc.

3. Delivery and Pickup

A. Pickup

If you choose to pick up your order, responsibility for the cake or baked goods transfers to you upon retrieval from our premises. We are not responsible for damage that occurs after the product has left our hands.

B. Delivery

If delivery is requested, the time slots are estimated. We will make every effort to deliver within the specified window. Risk of loss and damage passes to you upon delivery to the specified address. It is your responsibility to ensure the delivery location is accessible and a suitable recipient is available.

4. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Beverly Cakes and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

5. Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Beverly Cakes. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that Beverly Cakes shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

6. Limitation of Liability

In no event shall Beverly Cakes, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any goods or products purchased through the Service.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Emirate of Abu Dhabi and the Federal Laws of the UAE, without regard to its conflict of law provisions.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 07 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
